This section revises foreign gift and contract disclosure requirements for institutions of higher education under HEA §117 (20 U.S.C. 1011f) by (1) lowering the reporting threshold to any value (from $250,000) for gifts or contracts with a foreign source associated with a covered nation (i.e., as defined in 10 U.S.C. 4872(f)(2)), while retaining the $250,000 threshold for other foreign sources; (2) requiring the Secretary of Education to transmit copies of all such disclosures, documents, or records to the FBI Director and Director of National Intelligence within 10 days of receipt; and (3) adding a definition of "covered nation." (As background, HEA §117 requires institutions owned or controlled by a foreign source, or receiving qualifying gifts or contracts from foreign sources, to disclose them semiannually to promote transparency regarding potential foreign influence on U.S. campuses.) This section further requires the Secretary, not later than 90 days after enactment, to transmit all existing reports, documents, or records received or generated under HEA §117—regardless of date or case status—to the FBI Director and Director of National Intelligence.
