§2. Warrant requirement for electronic communication service and remote computing service records
This section amends Section 2703 of title 18, United States Code, part of the Stored Communications Act governing law enforcement access to stored electronic communications and non-content customer records, as follows: (1) requires a warrant for contents of wire or electronic communications in electronic storage with providers of electronic communication service, regardless of storage duration (previously, warrant required only if 180 days or less, with longer-duration content accessible via subsection (b) procedures); and (2) requires a warrant for non-content subscriber or customer records, including metadata as defined in 44 U.S.C. § 3502, held by providers of electronic communication service or remote computing service (previously available via administrative subpoena, grand jury or trial subpoena, or court order under subsection (d)). The amendments apply prospectively only, with no effect on disclosures required before enactment but treating any subsequent or expanded disclosures after enactment as new requests under the amended law.
