H.R. 2793 — Retirement Freedom Act

This section allows any individual entitled to benefits under Medicare Part A (i.e., hospital insurance under title XVIII of the Social Security Act) to elect to opt out of such entitlement, in a form and manner specified by the Secretary of Health and Human Services. Individuals who opt out (1) may subsequently end the election and opt back in without penalty, per a process determined by the Secretary; (2) are not required to opt out of Social Security benefits under title II of the Social Security Act; and (3) are not required to repay any Part A benefits received prior to opting out.
