H.R. 2816 — Shell Company Abuse Act

This section establishes a new criminal offense under 18 U.S.C. §612 prohibiting owners, officers, attorneys, or incorporation agents of a corporation, company, or other entity from establishing or using the entity to conceal prohibited election activities by a foreign national (as defined in 52 U.S.C. §30121, i.e., a non-U.S. citizen or national who is not a lawful permanent resident). (Such prohibited activities include foreign national contributions or expenditures in connection with federal, state, or local elections.) Violations are punishable by imprisonment for not more than five years, a fine under title 18, or both.
