H.R. 2838 — Ending Intermittent Energy Subsidies Act of 2025

This section terminates transferability under IRC §6418 of the portions of the clean electricity production credit (IRC §45Y) and clean electricity investment credit (IRC §48E) attributable to electricity produced or facilities used for wind or solar energy, for taxable years beginning after enactment. (Thus, only the portions not attributable to wind or solar remain transferable; the credits provide technology-neutral incentives for zero-emission electricity production at qualified facilities and related investments.)

This section phases out the clean electricity production credit (i.e., Section 45Y tax credit for zero-emission electricity production and sale at qualified facilities) for electricity produced from solar or wind energy by reducing the credit to (1) 80% of the otherwise applicable amount in the first calendar year after enactment, (2) 60% in the second calendar year, (3) 40% in the third, (4) 20% in the fourth, and (5) zero percent thereafter. The changes apply to electricity produced after enactment.

This section establishes a phase-out of the clean electricity investment credit for qualified facilities generating electricity using wind or solar energy, reducing the credit to 80% of the otherwise allowable amount in the first calendar year after enactment, 60% in the second, 40% in the third, 20% in the fourth, and 0% thereafter (from 100%). The amendments apply to facilities placed in service after enactment.
