H.R. 2888 — Stopping a Rogue President on Trade Act

This section terminates duties imposed by (1) Executive Order 14257 (90 Fed. Reg. 15041), (2) Executive Order 14193 (90 Fed. Reg. 9113), and (3) Executive Order 14194 (90 Fed. Reg. 9117), and any successor or substantially similar executive orders, effective on the date of enactment.

This section requires a joint resolution of approval, enacted into law, before the President may impose or increase a duty, quota, or tariff-rate quota on an imported article or suspend, withdraw, or prevent the application of trade agreement concessions with respect to such an article. The requirement does not apply to (1) antidumping and countervailing duties under title VII of the Tariff Act of 1930; (2) duties, quotas, and tariff-rate quotas under chapter 1 of title II of the Trade Act of 1974 (i.e., global safeguard measures); or (3) duties imposed consistent with rulings by certain dispute settlement panels under bilateral or plurilateral free trade agreements approved by Congress pursuant to fast-track procedures or under the Uruguay Round Agreements Act.

This section defines a joint resolution of approval—the sole matter after the resolving clause of which is "That Congress approves ___ imposed with respect to ___" (with the first blank filled by a description of the proposed action with respect to the article and the second by a description of the article)—and establishes expedited procedures for its consideration by applying subsections (b) through (f) of section 152 of the Trade Act of 1974 (19 U.S.C. 2192(b)-(f)), which provide for committee referral, discharge after 30 days, and related floor procedures. Such resolutions may be introduced by any Member of Congress, and the provision is enacted as a rule of each House, superseding other rules only to the extent inconsistent.
