H.R. 2892 — Hospital Adoption Education Act of 2025

This section sets forth congressional findings on adoption awareness and decision-making, including that (1) 24% of Americans have considered adopting a child; (2) 80% of women who consider adoption do so after their sixth month of pregnancy; (3) 81% of birth parents report that easy access to objective information is important when choosing adoption; (4) 93% of Americans consider hospitals and health care facilities trustworthy sources of adoption information; (5) 98.2% of nurses have no professional development in adoption sensitivities; and (6) less than 1% of women with unintended pregnancies place their children for adoption.

This section directs the Secretary of Health and Human Services to develop and nationally disseminate accurate, relevant, and accessible resources—including digital resources—to promote understanding of adoption sensitivities in the health care industry and best practices for interacting with prospective birth mothers and adoptive families. The section further requires the Secretary to maintain an adoption resources webpage for health care workers on the Administration for Children and Families public website and to develop the resources through a committee that includes representatives of adoption education organizations, maternal health experts, child welfare experts, licensed social workers, hospital case managers, and adoption attorneys.

This section directs the Secretary of Health and Human Services (HHS), acting through the Administration for Children and Families, to provide education and professional development to care providers at hospitals and birthing centers on patient care for families pursuing adoption—including prospective birth mothers and potential adoptive families—and to offer related consultation services on standardized policies, guidelines, and procedures, either directly or through grants or contracts. Grants or contracts are limited to three fiscal years and available only to health care-based nonprofit education organizations focused on adoption that meet specified criteria—such as partnering with health professionals and community organizations, emphasizing holistic perinatal parenting support, and having experience in non-directive education—while prohibiting child-placing agencies, abortion providers or referrers, or entities with a vested interest in pregnancy outcomes; grantees must submit annual reports and ensure funds supplement (not supplant) other resources. HHS must provide technical assistance to grantees, coordinate with other departmental adoption activities, evaluate program implementation and effectiveness by measuring the number of hospitals and birthing centers adopting related programming and the number of trained care providers, and submit a report to Congress within three years of enactment.

This section defines terms used in the Act, including (1) birth mother as a woman who places her baby with adoptive parents and terminates parental rights; (2) care provider as health care personnel (including bedside staff) and ancillary staff who have contact in a hospital or birthing center with expectant mothers, birth mothers, and potential adoptive families; (3) child-placing agency as a business or service engaged in finding homes for newborn infants by placing or arranging placement for adoption or foster care; (4) potential adoptive family as one or more individuals actively seeking to adopt a child; and (5) Secretary as the Secretary of Health and Human Services.
