This section revises the provision (INA §243(d)) authorizing the President, upon a report from the Secretary of Homeland Security (previously the Attorney General), to discontinue issuing visas to nationals of a country that refuses or fails to accept an alien subject to a final removal order. (As background, the provision promotes repatriation by nationals of noncooperative countries.) Specifically, the section (1) amends the heading to include "or failing to meet NATO obligations"; (2) replaces references to the Attorney General with the Secretary of Homeland Security; (3) expands the visa discontinuation trigger to also apply if a North Atlantic Treaty Organization member country spends less than 2% of its gross domestic product on national defense; and (4) specifies that the determination involves the Secretary of State.
