H.R. 2968 — Business over Ballots Act

This section expresses the sense of Congress that (1) the Small Business Administration (SBA) should focus on aiding small business concerns; (2) facilitating access to voter registration is beyond the SBA's mission and authority under federal law; and (3) no executive order may conflict with this Act or compel the SBA administrator to facilitate voter registration.

This section prohibits the Administrator of the Small Business Administration (SBA) from facilitating access to voter registration except as authorized by federal law. On or after enactment, it requires any SBA contract or agreement providing assistance to a person to include a term prohibiting use of such assistance to facilitate voter registration; prohibits existing recipients from using assistance for that purpose unless explicitly authorized in the terms of assistance; and bars the Administrator from directing or requesting a covered entity to engage in such facilitation unless authorized by Congress. Covered entities include entities, state governments, or local government units receiving SBA funding or assistance under a contract, cooperative agreement, or similar arrangement to administer an SBA program, but exclude persons receiving loans or guarantees under section 7 of the Small Business Act (15 U.S.C. 636).
