H.R. 2992 — To amend title 23, United States Code, and the Infrastructure Investment and Jobs Act with respect to vehicle roadside crashes, work zone safety, and for other purposes.

This section amends the Highway Safety Improvement Program (HSIP, 23 U.S.C. §148(c)(2))—which provides funding to states for highway safety projects to reduce fatalities and serious injuries—by expanding eligible safety concerns in three provisions to explicitly include occupants and pedestrians associated with disabled vehicles: (1) in hazard elimination activities (subpar. (A)(vi)); (2) in non-motorized uses (subpar. (B)(i)); and (3) in integrated safety approaches (subpar. (D)(vi)). This section further (1) amends injury health data requirements under the Infrastructure Investment and Jobs Act (IIJA, Pub. L. 117-58 §24108(c)(2)) to explicitly include roadside deaths and work zone deaths; (2) expands IIJA public awareness reviews of Move Over or Slow Down Laws (§24109(a)) to cover motorists, disabled vehicles, workers, vehicles, or machinery in work zones, in addition to authorized emergency vehicles; (3) directs the Secretary of Transportation, with the Occupational Safety and Health Administration (OSHA) and other agencies, to convene a disabled vehicle crash working group of stakeholders (e.g., truckers, first responders, insurers, manufacturers) to collect and publish crash data, develop a strategic plan for reducing injuries, improve data sharing with the National Highway Traffic Safety Administration (NHTSA) via Model Minimum Uniform Crash Criteria, and provide annual updates; (4) similarly directs a work zone crash working group with the Federal Highway Administration (FHWA), OSHA, and road-building stakeholders (e.g., contractors, unions) for comparable duties focused on work zones; and (5) requires the FHWA Administrator to submit annual reports to Congress on states' use of work zone safety contingency funds (23 U.S.C. §120(c)(3)(B)(vi)), including participating states, funding amounts dedicated, and recommendations for nationwide improvements.
