H.R. 2998 — Secure E-Waste Export and Recycling Act

This section defines electronic waste (i.e., used items containing electronic components such as computers, data center equipment, mobile devices, televisions, and consumer electronics, excluding motor vehicle parts and certain items exported for continued U.S. use) and exempted electronic waste items (i.e., tested working used electronics, low-risk counterfeit electronics destroyed for recycling feedstock, and manufacturer-repaired recalled electronics); prohibits any person or entity from exporting or reexporting electronic waste or exempted electronic waste items; and authorizes exports of exempted items if the exporter (1) is listed on a public registry maintained by the Secretary of Commerce, and (2) files electronic export information in the Automated Export System identifying the items, quantities, destinations, and consignees in accordance with the Export Administration Regulations. The section further defines counterfeit good (i.e., any good using a counterfeit mark, as defined in 18 U.S.C. §2320), counterfeit military good (i.e., a counterfeit good falsely labeled as meeting military specifications or intended for military/national security use), and related terms.
