H.R. 3001 — Modernizing America with Rebuilding to Kickstart the Economy of the Twenty-first Century with a Historic Infrastructure-Centered Expansion Act

This section provides the short title for this title as the “Modernizing America with Rebuilding to Kickstart the Economy of the Twenty-first Century with a Historic Infrastructure-Centered Expansion Act” or the “MARKET CHOICE Act”.

This section states congressional findings that roads, bridges, airports, and urban transportation systems are essential to U.S. economic and national security; there is a chronic funding shortfall for maintaining highways, bridges, and other critical infrastructure; strategic investments in new infrastructure promote economic growth; extreme weather events have increased and climate change impacts are expected to worsen; unaddressed climate change threatens Americans' health, the economy, and local, state, and federal budgets; climate risk reduction efforts must protect the economy, security, infrastructure, agriculture, water supply, public health, and public safety; and there is bipartisan support for reducing greenhouse gas emissions through economically viable private and public policies.

This section appropriates to the National Cancer Institute (NCI), for each of fiscal years 2026 through 2030 and to remain available until expended, an amount equal to 25% of the total amount appropriated to NCI for fiscal year 2024 to conduct or support cancer research. Such amounts are in addition to amounts otherwise available to NCI.

This section directs the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs and in collaboration with other relevant agencies, to study the reasons for cancer drug shortages—including economic factors, supply chain failures, delays or complications in drug development and FDA approval, and insufficient generic drugs and biosimilar biological products—and to submit a report on the results, including recommendations, to the appropriate congressional committees not later than one year after enactment.

This section establishes, not later than one year after the date of enactment, the Coordinator for Engagement with Defense Communities Affected by PFAS within the Department of Defense. The Coordinator is responsible for (1) improving the Department's outreach, education, and communication efforts with current or former U.S. defense communities affected by PFAS contamination or leakage; and (2) serving as a dedicated liaison between the Department and local governments, advocacy organizations, and individual citizens in communities with ongoing or incomplete DoD PFAS remediation projects.

This section establishes within the legislative branch the National Bipartisan Fiscal Commission not later than 90 days after enactment of this Act. The commission consists of 20 members, including (1) four Members of Congress appointed by the President (not more than two from the same party), (2) four appointed by the Speaker of the House, (3) four by the House Minority Leader, (4) four by the Senate Majority Leader, and (5) four by the Senate Minority Leader; the President designates the Chair and Vice Chair from among his appointees, with appointments due within 30 days of establishment. The commission must review long-term deficits and debt, recommend a legislative package to stabilize them (including requiring CBO to incorporate debt-servicing costs in cost estimates), and submit a report to Congress within 18 months; it has subpoena power (upon agreement of Chair and Vice Chair or affirmative vote of 10 members), authority to hold hearings and administer oaths, a quorum of 10 members, and is exempt from the Federal Advisory Committee Act.

This section requires the President, not later than 60 days after receiving a Commission report under section 401(d), to transmit to Congress a special message accompanied by a proposed joint resolution implementing the report's recommendations, following consultations with relevant congressional committees (for alternatives or exclusions), GAO, and CBO. The special message must specify included and excluded recommendations with reasons for exclusions, identify programs for elimination or consolidation, follow specified transmittal procedures if Congress is not in session, and be made publicly available including on a presidential website and via Federal Register notice. This section provides for expedited House consideration of a "Commission joint resolution" (i.e., one consisting solely of the President's proposed text), including (1) privileged introduction by the majority leader (or designee) on the next legislative day or by any Member thereafter; (2) committee reporting without amendment within 10 legislative days or discharge via privileged motion; and (3) a privileged motion to proceed after reporting or discharge.

This section prohibits Members of the House of Representatives from owning or trading covered financial instruments (i.e., securities or security futures as defined by the Securities Exchange Act of 1934, commodities as defined by the Commodity Exchange Act, or economic interests acquired synthetically such as through derivatives including options or warrants). Exceptions apply to widely held investment funds registered as management companies, U.S. Treasury bills, notes, or bonds; bonds issued by a state or local government; and Thrift Savings Plan investments. (Thus, House Members must divest non-exempt individual stocks, commodities, and derivatives.) The section further requires each Member to submit a pledge of compliance to the House Committee on Ethics and, upon request, provide necessary materials to verify compliance.

This section requires the Financial Institutions Examination Council, in consultation with specified stakeholders including the Secretary of the Treasury, trafficking victims, advocates, and law enforcement, to review and enhance within 180 days of enactment (1) training and examination procedures for anti-money laundering and countering the financing of terrorism programs to detect trafficking-related financial transactions; (2) procedures for referring potential trafficking cases to law enforcement; and (3) financial institution requirements to detect and deter money laundering related to severe forms of trafficking in persons. This section further requires the Interagency Task Force to Monitor and Combat Trafficking to submit to specified congressional committees and federal banking agencies within 270 days of enactment an analysis of U.S. government and financial institution anti-money laundering efforts against severe forms of trafficking in persons, along with legislative, administrative, and other recommendations—including feedback on best practices, training changes, information sharing, and statutory updates for emerging technologies and virtual currencies—to strengthen such efforts. This section specifies that it does not grant rulemaking authority to the task force or encourage financial institutions to deny services to trafficking victims or non-responsible individuals and provides definitions for relevant terms, including "Federal banking agency," "severe forms of trafficking in persons," "Interagency Task Force to Monitor and Combat Trafficking," and "law enforcement agency."

This section adds a new criterion (paragraph (13)) to the list of factors in 22 U.S.C. 7106(b) for determining whether a foreign government is making serious and sustained efforts to eliminate severe forms of trafficking in persons, as required under the Trafficking Victims Protection Act of 2000. (As background, these criteria inform the Department of State's annual Trafficking in Persons Report, which classifies countries into tiers and may trigger U.S. sanctions or aid restrictions for Tier 3 countries.) The new factor evaluates whether the government, consistent with its capacity, has a framework to prevent financial transactions involving proceeds of severe forms of trafficking in persons and is taking steps to implement it, including by investigating, prosecuting, convicting, and sentencing individuals who attempt or conduct such transactions.

This section directs the Director of the Cybersecurity and Infrastructure Security Agency (CISA) to convene, not later than 90 days after enactment and in consultation with the Secretary of Homeland Security, a rulemaking advisory committee—chaired by the CISA Director and including the Secretary of Education (or designee) and representatives from law enforcement, school safety personnel, advocates, educators, ballistic shielding experts, school construction experts, and others—to develop findings and recommendations for requiring the installation or modification of interior and exterior doors in federally funded primary and secondary schools. The committee must consider reinforced door requirements and technologies, performance standards, development and testing, service lifetime, threat protection without impeding law enforcement pursuit or evacuations, and other factors determined by CISA. Not later than one year after convening the committee, CISA must submit a report on its findings and recommendations to the House and Senate Homeland Security, Education, and related committees. Not later than six months after submitting the report, CISA must issue a final rule requiring such door installations or modifications. This section is administered under the State Homeland Security Grant Program (6 U.S.C. 605), which provides grants to states (with an 80% pass-through to local and tribal governments) to prevent, prepare for, protect against, and respond to acts of terrorism. (As background, states apply annually, detailing fund uses and allocations.) This section authorizes an additional $100 million for the program for the fiscal year in which the final rule is issued and each of the nine fiscal years thereafter, to be obligated and expended only for carrying out this section.

This section requires states to permit unaffiliated voters (i.e., individuals not registered as members of or otherwise affiliated with a political party) registered for federal elections to vote in any primary election for federal office, except that a state may not permit such a voter to participate in primaries of more than one political party. It prohibits states from sharing unaffiliated voters' primary election information (e.g., name and contact details) with political parties or for political or commercial solicitation purposes and from treating such voters as party-affiliated on official registration lists based solely on their primary participation. This section prohibits states from using any federal funds provided directly for election administration unless the state certifies to the Election Assistance Commission that it applies the same access, information-sharing, and affiliation-status rules to primaries for state and local office. This section directs the Election Assistance Commission to make transition assistance grants to states certifying compliance, in an amount equal to 2% of the total requirements payments received by the state under section 251 of the Help America Vote Act of 2002 (i.e., annual payments to states meeting Help America Vote Act voting system, voter registration, and other requirements), for the fiscal year of certification and each of the four succeeding fiscal years; states must use the grants to cover implementation costs. It authorizes appropriations for these grants for FY2026 and each succeeding fiscal year. This section applies to elections held after the date of enactment.

This section (1) declares it the policy of the United States that noncitizens may not vote in any taxpayer-funded election for public office held by or in the United States or any state; (2) prohibits states from permitting noncitizens to vote in any election for federal office; and (3) prohibits states from using federal funds provided directly for election administration unless the state certifies to the Election Assistance Commission that noncitizens are not permitted to vote in any election for state or local office or any ballot initiative or referendum.

This section directs the Director of National Intelligence, in consultation with the Secretary of Defense and the Director of the Central Intelligence Agency, to conduct a review and issue a classified report to the House Permanent Select Committee on Intelligence and the Senate Select Committee on Intelligence not later than 90 days after enactment of this Act determining whether increased intelligence sharing with Ukraine relating to the Russian Federation, Belarus, China, North Korea, or other entities determined appropriate by the Director improves the security of the United States and its allies and partners.

This section includes veteran-owned small business concerns—defined by reference to the Small Business Act (15 U.S.C. 632(q))—within the Disadvantaged Business Enterprises (DBE) program established by the Infrastructure Investment and Jobs Act (i.e., requires recipients of certain DOT transportation funds to set overall and contract-specific goals for DBE participation). Specifically, it (1) adds the definition to the program's defined terms; (2) designates veteran-owned small business concerns as eligible DBEs; and (3) adds veterans to the list of groups presumed socially and economically disadvantaged.

This section expands eligibility for the increased rate of Dependency and Indemnity Compensation (DIC) under 38 U.S.C. 1311(a)(2)—which requires a service-connected total disability for eight years or more immediately preceding death—to surviving spouses of veterans who die from amyotrophic lateral sclerosis (ALS), without regard to the duration of the veteran's ALS prior to death. (As background, DIC provides monthly tax-free payments to eligible survivors of veterans whose death resulted from a service-connected condition or who were totally disabled at death.) For this purpose, the term surviving spouse means a person married to the veteran continuously for eight years or longer prior to death, with the changes applicable to ALS deaths on or after October 1, 2025.

This section directs the Secretary of Veterans Affairs, not later than 180 days after enactment, to submit to Congress a report identifying any service-connected disability other than amyotrophic lateral sclerosis that should be treated in the same manner as amyotrophic lateral sclerosis under 38 U.S.C. 1311(a)(2)(B)-(C), as added by section 1202. The report must include (1) a comprehensive list of service-connected disabilities with high mortality rates and (2) detailed information on the average life expectancy for persons with each such disability.
