H.R. 3026 — Protecting America’s Cybersecurity Act

This section requires, at the election of the affected individual, reinstatement with back pay under the Back Pay Act (5 U.S.C. 5596) for any individual involuntarily removed from the Cybersecurity and Infrastructure Security Agency (CISA) between January 25, 2025, and March 1, 2025. The section prohibits (1) involuntary removal from or transfer outside of CISA and (2) impoundment, transfer, or reprogramming of CISA appropriations unless authorized by a law enacted after this Act's enactment or by specific appropriations acts for the agency. These requirements do not apply to political positions (i.e., Executive Schedule positions under 5 U.S.C. §§5312-5316, non-career Senior Executive Service positions, or Schedule C positions), removals for misconduct or delinquency, or removals preceded by an unacceptable or less-than-fully-successful performance rating.

This section prohibits the obligation or expenditure of federal funds for the salary or expenses of any employee of the Department of the United States DOGE Service (commonly referred to as the Department of Government Efficiency or DOGE) or any DOGE agency team member transferred, detailed, or otherwise working at the Cybersecurity and Infrastructure Security Agency (CISA).
