H.R. 3030 — Highway Formula Fairness Act

This section authorizes the Secretary of Transportation to provide additional amounts under the minimum apportionment formula for federal-aid highway programs (23 U.S.C. §104(c)(1)) to states that have increased in population since the previous decennial census, apportioned proportionally based on each state's relative increase as determined appropriate by the Secretary. The amendments apply beginning with the first fiscal year after enactment.

This section directs the Secretary of Transportation, in consultation with state departments of transportation and local government representatives (including metropolitan planning organizations), to conduct a highway formula modernization study assessing the method and data used to apportion Federal-aid highway funds under 23 U.S.C. 104(b) and (c). The study must evaluate, using the latest data, whether the apportionment ensures equitable distribution based on estimated tax payments by state highway users to the Highway Trust Fund and general fund contributions to the Highway Trust Fund, and achievement of the national transportation goals in 23 U.S.C. 101(b)(3); consider pre-SAFETEA-LU factors from specified sections of title 23, data availability and accuracy, performance measures under 23 U.S.C. 150, and other appropriate factors; and develop recommendations for a new apportionment method, including factors, weighting, and steps to promote equity and the specified goals. The Secretary must submit a report containing the study and recommendations to Congress within 90 days of enactment.
