H.R. 3058 — Reclaim the Reins Act

This section appropriates $10 million to the Director of the Office of Management and Budget (OMB) and $10 million to the Comptroller General of the United States for FY2025, available through September 30, 2034, to implement enhanced congressional review of agency rulemaking under the Congressional Review Act (CRA, 5 U.S.C. ch. 8). The section revises the CRA by (1) expanding the definition of "rule" in 5 U.S.C. §804(3) to include interpretive rules, general statements of policy, and all other agency guidance documents (previously excluded under the §551 definition); (2) requiring agencies submitting CRA reports under 5 U.S.C. §801(a)(1)(A) to include additional elements such as budgetary effects, cost analyses, jobs added or lost by North American Industrial Classification System code (public and private sectors), OMB Administrator's major/nonmajor determination with criteria-specific explanation, data sources, related regulations, inflation effects, and constitutional authority; and (3) directing the Comptroller General, upon written request by a Member of Congress, to determine within 60 days if an agency action is a "rule" or within 90 days (with the Congressional Budget Office) if it is a major rule, with such determinations treated as §801(a)(1)(A) reports. The section further requires a joint resolution of congressional approval for any major rule determined under new §809(a) to increase revenues, which shall not take effect without enactment within 60 session or legislative days of Congress's receipt of the report (excluding adjournments over three days); otherwise, the rule is deemed not approved. (Thus, this reverses the CRA's standard disapproval process for such rules.) It also subjects revenue-increasing rules submitted in a President's final year to disapproval procedures under 5 U.S.C. §802 in the succeeding congressional session, allowing joint resolutions to cover multiple rules. Courts may review agency compliance with these requirements notwithstanding 5 U.S.C. §805.
