This section prohibits owners of covered federally assisted rental dwelling units, after the 1-year period beginning on the date of enactment, from using or authorizing facial recognition technology, physical biometric recognition technology (i.e., based on DNA, fingerprints, palmprints, iris, or retina), or remote biometric recognition technology (i.e., based on gait, voice, or other remote immutable characteristics) in such units, buildings, or grounds for surveillance or any purpose adversely affecting tenants' access to affordable housing free from bias and discrimination. Covered units are residential dwelling units assisted under 10 specified federal programs, including public housing and Section 8 under the U.S. Housing Act of 1937, the Section 202 supportive housing for the elderly program (12 U.S.C. 1701q), the Section 811 supportive housing for persons with disabilities program, and others.
This section directs the Secretary of Housing and Urban Development (HUD) to submit to the House Committee on Financial Services and the Senate Committee on Banking, Housing, and Urban Affairs, and to make publicly available on the department's website, a report no later than one year after enactment that describes (1) any known usage of facial recognition technology, physical biometric recognition technology, or remote biometric recognition technology in covered federally assisted dwelling units during the five years preceding enactment; (2) any known adverse effects for tenants from such usage; (3) the impact of such technology on residents; (4) the purpose of installing such technology; (5) demographic information about affected residents and surrounding areas; and (6) potential impacts on vulnerable communities—including those protected under the Fair Housing Act of 1968—of additional usage, including effects on privacy, civil rights, and fair housing.
