H.R. 3062 — Promoting Cross-border Energy Infrastructure Act

This section establishes a certificate of crossing requirement, administered by the Federal Energy Regulatory Commission (FERC) for oil or natural gas pipelines and by the Secretary of Energy for electric transmission facilities, for constructing, connecting, operating, or maintaining new border-crossing facilities for importing or exporting oil or natural gas or transmitting electricity across U.S. international borders. The relevant official or agency must issue the certificate within 120 days after completing review under the National Environmental Policy Act unless the facility is not in the public interest; the requirement excludes existing facilities, those with issued or pending Presidential permits as of enactment (with pending applications expiring after two years), and modifications to existing facilities; and it does not affect other statutory requirements, including NGA §§3 and 7 approvals or FERC authority over oil pipelines. (Thus, the process replaces prior Presidential permit requirements under executive orders.) This section also (1) amends NGA §3(c) to require FERC to approve applications for importing natural gas from or exporting to Canada or Mexico within 30 days of receiving a complete application; (2) repeals FPA §202(e), which previously required a Presidential order for exporting or importing electric energy to a foreign country, with conforming amendments to FPA §202(f) and PURPA §602(b); and (3) eliminates any requirement for a Presidential permit for oil or natural gas pipelines, electric transmission facilities, or their border-crossing components.
