This section amends the federal murder statute to include distributing fentanyl resulting in death as a predicate offense for first-degree murder within the special maritime and territorial jurisdiction of the United States. Specifically, it (1) adds "distributing fentanyl" to the list of felonies in 18 U.S.C. §1111(a) under which a resulting murder constitutes first-degree murder; (2) specifies that first-degree murder by distributing fentanyl is punishable by death or life imprisonment; and (3) defines "distributing fentanyl" to mean knowingly distributing 2 grams or more of a mixture containing detectable fentanyl (i.e., N-phenyl-N-[1-(2-phenylethyl)-4-piperidinyl] propanamide) or 0.5 grams or more of a fentanyl analogue, where such distribution results in death from the use of the substance (cross-referencing definitions of "controlled substance" and "distribute" in the Controlled Substances Act).
