H.R. 3071 — Increasing Penalties for Offshore Polluters Act

This section modifies civil penalties for discharges of oil or hazardous substances under section 311(b)(7) of the Federal Water Pollution Control Act (FWPCA) by replacing maximum amounts ("an amount up to" and "not more than") with minimum amounts ("an amount that is at least" and "at least"). It also increases criminal penalties under FWPCA section 309(c) as follows: (1) in paragraph (1), fines to $5,000 (from $2,500) and $50,000 (from $25,000), maximum imprisonment to 2 years (from 1 year), and maximum punishment doubled for both fine and imprisonment; (2) in paragraph (2), minimum fine to $10,000 (from $5,000) and maximum fine to $100,000 (from $50,000), maximum imprisonment to 6 years (from 3 years), and maximum punishment doubled for both fine and imprisonment; and (3) in paragraph (3)(A), fines to $500,000 (from $250,000) and $2,000,000 (from $1,000,000), and maximum imprisonment to 30 years (from 15 years).
