H.R. 3079 — Medicaid Empowerment Act of 2025

This section extends the maximum renewal periods for certain Medicaid home and community-based services (HCBS) waivers under subsection (c) and related extensions under subsection (h), as well as for state plan HCBS amendments under subsection (i), to 10-year periods or terms (from 5-year periods or terms) for those beginning on or after the date of enactment of the Medicaid Empowerment Act of 2025. (As background, these provisions—SSA §1915(c), (h), and (i)—enable states to waive certain Medicaid requirements to furnish long-term HCBS as cost-effective alternatives to institutional care for eligible individuals, such as the aged, blind, or disabled.) Specifically, the section makes the following changes: (1) in subsection (c)(3), after "five-year periods"; (2) in subsection (h)(2), after "5-year periods"; and (3) in subsection (i)(7)(C), after "5-year terms". (Thus, states may renew and extend these programs less frequently.)
