H.R. 3083 — Consent is Key Act

This section requires the Attorney General to increase the amount provided to a state under covered formula grants if the state has a law authorizing civil actions for damages and equitable relief against persons who engage in nonconsensual sexual protection barrier removal.

This section requires a state seeking an increase in funding under a covered formula grant to include in its grant application information specified by the Attorney General, including details on the law described in section 2.

This section limits the increase provided to a State under the covered formula grant to no more than 20% of the average total funding provided to that State under its three most recent awards.

This section requires the Attorney General to provide any increase in a state's covered formula grant funding for a 4-year period and limits such increases to no more than 4 per state.

This section defines, for purposes of the Act, (1) "covered formula grant" as a grant under the Sexual Assault Services Program; (2) "nonconsensual sexual protection barrier removal" as removal without consent of a sexual protection barrier from a body part, including the genitals, or an object used for sexual contact with another person, causing sexual contact between such body parts or objects and the body of any person engaged in the contact; and (3) "sexual protection barrier" as a condom (including an internal condom), dental dam, or other barrier against sexual fluids during sexual contact.
