H.R. 3092 — Electrodiagnostic Medicine Patient Protection and Fraud Elimination Act of 2025

This section establishes new Medicare Part B payment conditions for electrodiagnostic services—nerve conduction studies and needle electromyography tests—by prohibiting payment for such services furnished on or after a Secretary-determined date (not earlier than 3 years and not later than 4 years after enactment) unless furnished at a qualified facility, with an exception for intraoperative neuromonitoring. (Qualified facilities must be accredited by Secretary-specified organizations and meet requirements including a quality assurance program, use of specified devices, minimum training for needle electromyography performers, on-site real-time interpretation of results by the performer or supervisor, and other Secretary-determined standards.) It further directs the Secretary to (1) specify accrediting organizations within 2 years of enactment, in consultation with an advisory committee and prioritizing widely recognized entities; (2) finalize regulations within 1 year outlining processes for specifying organizations, reaccreditation reviews, withdrawal of approval, and effects on accredited facilities; and (3) establish within 2 years the National Electrodiagnostic Services Advisory Committee (composed of 9-11 non-federal experts, including physicians experienced in these services) to recommend facility requirements, regulations, and accrediting organizations, prioritizing reductions in unnecessary treatments, retesting, and fraud while improving diagnostic reliability and health outcomes.
