H.R. 31 — POLICE Act of 2025

This section establishes a new criminal ground of deportability under INA §237(a)(2) (8 U.S.C. 1227(a)(2)) for any alien convicted of, who admits having committed, or who admits committing acts constituting the essential elements of assaulting a law enforcement officer. The assault must occur while the officer is engaged in the performance of official duties, because of such performance, or because of the officer's status as a law enforcement officer (i.e., a person authorized to prevent, detect, investigate, prosecute, or incarcerate for criminal violations of law; to apprehend, arrest, or prosecute individuals for crimes; or to serve as a firefighter or other first responder). "Assault" has the meaning given in the jurisdiction where the act occurred.

This section directs the Secretary of Homeland Security to submit to Congress, and make publicly available on the Department of Homeland Security's website, an annual report on the number of aliens deported during the previous year under INA §237(a)(2)(G) (i.e., for assaulting, threatening, or conspiring to assault a law enforcement officer).
