H.R. 3100 — To amend the National Child Protection Act of 1993 to ensure that businesses and organizations that work with vulnerable populations are able to request background checks for their contractors who work with those populations, as well as for individuals that the businesses or organizations license or certify to provide care for those populations.

This section expands the definition of covered individual under the National Child Protection Act of 1993—which authorizes FBI criminal history background checks via states for individuals with access to children, the elderly, or individuals with disabilities served by qualified entities (i.e., care providers such as child care businesses or organizations)—to encompass four categories in subclause (B): (1) contractors with, or seeking to contract with, qualified entities (in addition to existing employees, volunteers, or applicants); (2) employees or volunteers with, or seeking employment or volunteer positions with, entities under contract with qualified entities; (3) owners or operators of, or those seeking to own or operate, qualified entities (previously the only other category); and (4) individuals licensed or certified by, or seeking licensure or certification from, qualified entities. (Thus, these individuals become eligible for FBI background checks to identify child abuse crimes prior to hiring, contracting, or licensure.)
