H.R. 3103 — Health Share Transparency Act of 2025

This section establishes disclosure requirements for health care sharing ministries (HCSMs)—nonprofit organizations exempt from certain Affordable Care Act (ACA) requirements under which members share eligible medical expenses—by adding a new part to Title XXVII of the Public Health Service Act. Specifically, it requires each HCSM to (1) submit annually to the Secretary of Health and Human Services, IRS Commissioner, and CFPB Director specified financial and operational information (e.g., reserves held, claims denial percentage, average reimbursement time, enrollment by state/county, contracted providers), which the Secretary must publish on a public website; (2) disclose to prospective and current enrollees, prominently in multiple languages immediately before enrollment and in at least 14-point font (or read aloud for phone enrollments), details such as appeal processes, lack of reimbursement guarantees, lifetime caps if any, average out-of-pocket expenses and per-enrollee payments, nonreimbursable items/services, and claims payment versus cost-sharing data; and (3) prohibit contracts or remuneration to enrollment-assisting entities unless those entities inform prospective enrollees of available premium tax credits under IRC §36B, Medicaid eligibility under SSA title XIX, and Medicare eligibility under SSA titles XVIII parts A/B.
