H.R. 3104 — Ukrainian Adjustment Act of 2025

This section establishes a streamlined process for the Secretary of Homeland Security to adjust the status of eligible Ukrainian nationals to that of a lawful permanent resident, notwithstanding other provisions of law. Eligible individuals include citizens or nationals of Ukraine (or those who last habitually resided there) who were paroled into the United States after February 20, 2014—or paroled to accompany or join such individuals as spouses, children, parents, legal guardians, or primary caregivers of unaccompanied children—and whose parole has not been terminated. To qualify, applicants must submit an application per DHS procedures, be otherwise admissible as immigrants (except that public charge [INA §212(a)(4)], labor certification [§212(a)(5)], and documentation [§212(a)(7)(A)] grounds do not apply), satisfy refugee-equivalent vetting including an interview, and be determined not contrary to U.S. national welfare, safety, or security; the Secretary may additionally waive most other inadmissibility grounds for humanitarian purposes, family unity, or public interest (except security-related grounds under INA §212(a)(2)(C) or (3), and post-February 20, 2014, U.S. criminal conduct under §212(a)(2)). The section further (1) provides protections for battered spouses or children of eligible Ukrainians, allowing adjustment eligibility for up to two years post-marriage termination with demonstrated abuse-related causation and applying special self-petition rules; (2) records approved adjustment as of the original parole date; and (3) generally prohibits additional parole authorization for eligible Ukrainians who fail to apply within one year of final DHS guidance publication or personal eligibility determination.
