H.R. 3164 — Ensuring Community Access to Pharmacist Services Act

This section establishes coverage under Medicare Part B for pharmacist services (i.e., evaluation and management visits, testing, or treatment for COVID-19, influenza, respiratory syncytial virus, streptococcal pharyngitis, or public health needs during a declared public health emergency, if legally authorized under state law and furnished under required physician/practitioner supervision or collaboration). It provides payment at 80 percent of the lesser of the actual charge or 85 percent of the physician fee schedule amount under Medicare Part B (or 100 percent of such amount for services addressing public health emergency needs); prohibits balance billing for such services (i.e., requires acceptance of Medicare assignment); with applicability to services furnished on or after January 1, 2026.
