H.R. 3167 — Noncontiguous Energy Relief and Access Act of 2025

This section amends coastwise trade exemption provisions (46 U.S.C. 55102) by (1) replacing subsection (a) with definitions of "covered noncontiguous trade" (i.e., trade between the contiguous 48 states and Alaska, Hawaii, Guam, or Puerto Rico, or between such noncontiguous locations), "energy products" (i.e., equipment, components, or energy sources for electricity generation, storage, transmission, or distribution), "energy source" (i.e., liquefied natural gas or other sources needed for electricity generation, and petroleum products), "equipment" (e.g., power generators, storage units, wind turbines, solar panels, hydroelectric plants), "merchandise" (including government-owned goods and valueless material), and "petroleum product" (as defined in the Energy Policy and Conservation Act); (2) redesignating subsection (c) as subsection (d); and (3) inserting subsection (c) to exempt vessel transportation of energy products in covered noncontiguous trade from the requirements of subsection (b). (Thus, energy products may be transported by non-coastwise-qualified vessels between points in the contiguous United States and noncontiguous regions or among noncontiguous regions.)
