H.R. 32 — No Bailout for Sanctuary Cities Act

This section defines the term “sanctuary jurisdiction” for purposes of the Act as any state or political subdivision with a statute, ordinance, policy, or practice that prohibits or restricts any government entity or official from (1) sending, receiving, maintaining, or exchanging information regarding an individual’s citizenship or immigration status with federal, state, or local government entities; or (2) complying with a Department of Homeland Security request under INA §236 (8 U.S.C. 1226, detention pending removal decision) or §287 (8 U.S.C. 1357, immigration officer powers) for a detainer or release notification. A state or political subdivision is not deemed a sanctuary jurisdiction based solely on such a policy for individuals who come forward as victims or witnesses to a criminal offense.

This section makes sanctuary jurisdictions ineligible to receive federal funds that they intend to use for the benefit—including food, shelter, healthcare services, legal services, or transportation—of aliens present in the United States without lawful status under the Immigration and Nationality Act (INA), beginning on the earlier of 60 days after enactment or the first day of the fiscal year following enactment.

This section directs the Secretary of Homeland Security to submit to the House and Senate Committees on the Judiciary, not later than one year after enactment and annually thereafter, a report listing states and political subdivisions that have failed to comply with requests described in section 2(a)(2).
