H.R. 3279 — REG Budgeting Act of 2025

This section requires the Director of the Office of Management and Budget (OMB), acting through the Office of Information and Regulatory Affairs, to establish by September 30 of each fiscal year (1) an overall limit on additional unfunded regulatory costs that all federal agencies collectively may impose in the next fiscal year and (2) agency-specific limits proposed by each agency at least 90 days in advance, potentially including requirements to reduce cumulative prior costs for offsets. Limits allowing any net increase in such costs require congressional approval via joint resolution, with no net increase permitted pending approval; the Director must report all limits to specified congressional committees within seven days and publish them online, prohibiting agencies from finalizing cost-imposing rules until reports are submitted (except for rules addressing emergencies, criminal enforcement, national security, or trade agreements). If a rule would exceed an applicable limit, it cannot take effect that fiscal year without congressional approval via joint resolution; unapproved rules may take effect in a future year if their costs are identified by the agency and accounted for in that year's limits (subject to any net-increase approval requirement).
