This section establishes federal penalties for murder committed by certain inadmissible or deportable aliens within any jurisdiction of the United States (not limited to the special maritime and territorial jurisdiction). It subjects such aliens to punishment by death or life imprisonment for first-degree murder, or imprisonment for any term of years or life for second-degree murder, if inadmissible under Immigration and Nationality Act provisions for presence without admission or parole (INA §212(a)(6)(A)), fraud or willful misrepresentation (INA §212(a)(6)(C)), or lack of valid entry documents (INA §212(a)(7)); or deportable for presence without admission or parole (INA §237(a)(1)(B)) or failure to maintain nonimmigrant status (INA §237(a)(1)(C)(i)). (Thus, these penalties apply nationwide using the existing definitions of first- and second-degree murder in 18 U.S.C. §1111(a).)
