H.R. 3299 — Restroom Access Act of 2025

This section requires any retail establishment (i.e., a place of business open to the public for the sale of goods or services in interstate commerce) with a non-public restroom to allow a lawfully present customer with an eligible medical condition (i.e., inflammatory bowel disease such as Crohn's disease, ulcerative colitis, or irritable bowel syndrome; use of an ostomy device; or another diagnosed condition such as pregnancy requiring immediate access) to use that facility during business hours, if the customer presents a specified identification card, at least two employees are on duty, access does not pose an obvious health or safety risk, and no public restroom is available. Directs the Secretary of Labor, not later than 180 days after enactment, to establish a system to create and distribute such identification cards to individuals certified by a medical professional (i.e., physician, naturopathic physician, physician assistant, nurse, or nurse practitioner) to have an eligible medical condition.
