H.R. 3300 — Forest Protection and Wildland Firefighter Safety Act of 2025

This section expands the exemption from National Pollutant Discharge Elimination System (NPDES) permit requirements under the Clean Water Act to include, in addition to the prior exemption, discharges resulting from the aerial application of a product used for fire control and suppression purposes that appears on the most current applicable Qualified Products List maintained by the Forest Service (or any successor list). (Thus, such aerial firefighting discharges into navigable waters are not subject to NPDES permitting.) It also makes technical and conforming changes to subparagraph (C), including adding an "Applicability" heading and updating cross-references.
