This section requires any person selling a good to a U.S. consumer to display, in a clear and conspicuous manner, the portion of the good's price attributable to a covered tariff (identified as the "tariff surcharge"), with an exemption for small business concerns (as defined in the Small Business Act). It authorizes the Federal Trade Commission (FTC) to promulgate implementing regulations under the Administrative Procedure Act's notice-and-comment procedures (5 U.S.C. §553); treats violations (including of such regulations) as a violation of an FTC rule under section 18(a)(1)(B) of the FTC Act (15 U.S.C. §57a(a)(1)(B)) regarding unfair or deceptive acts or practices; and provides for FTC enforcement using all applicable powers, penalties, privileges, and immunities under the FTC Act (15 U.S.C. §41 et seq.). The requirements apply to sales occurring 30 days after enactment. It defines "covered tariff" as a tariff (including rate change) imposed on an emergency or other discretionary basis by the President that entered into force on or after January 20, 2025.
