H.R. 3310 — Venezuela TPS Act of 2025

This section designates Venezuela for temporary protected status (TPS) under INA §244 (8 U.S.C. 1254a)—which provides temporary protection from removal and work authorization to eligible nationals of countries facing extraordinary and temporary conditions—for an initial 18-month period beginning on the date of enactment. Eligible Venezuelan nationals are those continuously physically present in the United States since enactment who are admissible as immigrants (except as provided under INA §244(c)(2)(A)), not ineligible under INA §244(c)(2)(B), and who register as specified by the Secretary of Homeland Security. The section further (1) authorizes the Secretary to consent to brief travel abroad for TPS beneficiaries under emergency and extenuating circumstances, with returning aliens inspected as other TPS holders; and (2) imposes a $360 fee on applications eligible solely due to this designation, with fee waivers available.

This section specifies that the budgetary effects of this Act, for purposes of compliance with the Statutory Pay-As-You-Go Act of 2010, are to be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” submitted for printing in the Congressional Record by the Chairman of the House Budget Committee prior to the vote on passage.
