H.R. 3353 — Lieutenant Osvaldo Albarati Stopping Prison Contraband Act

This section amends penalties for contraband in federal prisons under 18 U.S.C. 1791(b) by (1) inserting new paragraph (4) to establish imprisonment for not more than 2 years, or both, for providing a phone specified in 18 U.S.C. 1791(d)(1)(F) and (2) specifying that redesignated paragraph (5) applies to prisoner possession of such a phone. (As background, 18 U.S.C. 1791 prohibits conveying contraband—including phones—to federal prisoners and prisoner possession thereof, with tiered penalties by contraband type.)

This section directs the Director of the Bureau of Prisons, not later than one year after enactment, to (1) review agency policies pertaining to inmates who make, possess, obtain, or attempt to make or obtain a prohibited object (i.e., contraband such as weapons or drugs, as defined in 18 U.S.C. § 1791(d)(1)); and (2) update those policies as needed to improve protections for incarcerated individuals and staff.
