This section states the following congressional findings: (1) President Trump issued Executive Order 14160 (90 Fed. Reg. 8449), entitled “Protecting the Meaning and Value of American Citizenship,” on January 20, 2025, to prohibit federal departments and agencies from recognizing the citizenship of certain children born in the United States; (2) the 14th Amendment provides that all persons born or naturalized in the United States and subject to its jurisdiction are citizens; (3)-(4) in United States v. Wong Kim Ark, 169 U.S. 649 (1898), the Supreme Court held that the 14th Amendment's birthright citizenship clause includes children born in the United States to resident aliens; (5) federal courts have ruled against the constitutionality of Executive Order 14160; and (6) birthright citizenship, as provided in the 14th Amendment and 8 U.S.C. 1401 et seq., cannot be rescinded by executive order or act of Congress.
This section prohibits the use of federal funds to carry out Executive Order 14160 (relating to protecting the meaning and value of American citizenship) or any successor executive order, regulation, or policy.
