H.R. 3403 — SEAT Act of 2025

This section requires a provider of a third-party restaurant reservation service (i.e., any website, mobile application, or other internet-based service, other than the establishment itself, that lists, promotes, sells, or otherwise makes available reservations for on-premises dining or drinking at a food service establishment) to obtain a written agreement from the food service establishment (i.e., a restaurant, bar, food truck, or similar place where the public assembles to be served food or drink, including those in larger complexes such as hotels or stadiums) or its contractual designee prior to listing, promoting, selling, or otherwise making available such reservations. The section further (1) treats violations as unfair or deceptive acts or practices under FTC rules (15 U.S.C. 57a(a)(1)(B)), enforceable by the Federal Trade Commission (FTC) with all applicable powers, penalties, privileges, and immunities of the FTC Act; (2) applies beginning 180 days after enactment; and (3) prohibits any such agreement from requiring the food service establishment to indemnify the service provider (or its contractors or agents) for damages or harm caused by the provider's own acts or omissions, deeming any such provision void and unenforceable.
