H.R. 343 — Title X Abortion Provider Prohibition Act

This section prohibits the Secretary of Health and Human Services from providing Title X family planning assistance (i.e., grants for voluntary family planning services, including contraception, primarily to low-income individuals) to any entity unless the entity certifies that it will not perform abortions or provide funds to any other entity that does during the assistance period. The prohibition does not apply to abortions resulting from rape or incest, or where a physician certifies that the woman faces danger of death unless an abortion is performed (including from a life-threatening pregnancy-related condition); it also does not apply to hospitals that do not fund non-hospital abortion providers (except under those exceptions). (Thus, "entity" encompasses affiliates under common control, restricting assistance to abortion-free organizations or affiliates.) This section further requires the Secretary to submit to Congress, within 60 days of enactment and annually thereafter, a report listing Title X grantees, numbers of exception abortions (total, by rape, by incest, and physician-certified), dates of latest grantee certifications, and any subrecipients of grantee funds.
