This section establishes an exemption from the minimum wage (29 U.S.C. 213(a)) and overtime requirements of the Fair Labor Standards Act for employees primarily engaged in outdoor recreational outfitting (including equipment rentals) or guiding services (e.g., rafting or hiking guides) who are employed by a business that either (1) does not operate for more than seven months in any calendar year or (2) had average receipts for any six months of the preceding calendar year that were not more than 33 1/3 percent of its average receipts for the other six months of such year. (Thus, these seasonal businesses and employees are treated similarly to those exempt under existing law for certain amusement or recreational establishments and organized camps.)
