H.R. 3503 — Kidney Donation Anti-Discrimination Act

This section prohibits discrimination against living kidney donors in the offering, issuance, cancellation, price or conditions of a life insurance policy, or in the amount of coverage provided, based solely on donor status without evidence of additional actuarial risks unrelated to the donation. It (1) authorizes a private right of action in federal district court for damages and attorney's fees; (2) states that it does not preempt state or local laws providing greater protection to living kidney donors; and (3) defines "life insurance policy" as a contract paying a designated beneficiary upon the insured's death and "living kidney donor" as a non-deceased individual who has donated a kidney.
