§2. Relocation of memorial honoring the 9 Air Force crew members who lost their lives in an airplane crash during a training mission on August 31, 1982
This section authorizes the Secretary of Agriculture to permit, by special use authorization, the relocation and installation of a memorial honoring nine Air Force crew members killed in a C-141B transport plane crash during a training mission over the Cherokee and Nantahala National Forests on August 31, 1982, from adjacent private land to the Stratton Ridge rest area at mile marker 2 on the Cherohala Skyway in Graham County, North Carolina, in the Nantahala National Forest. The authorization requires the private landowner's consent, site approval by the Secretary in concurrence with the North Carolina Department of Transportation (and the Federal Highway Administration if adjacent to a Federal-aid highway), no use of federal funds, payment of all associated costs (including application processing, environmental analysis, relocation, installation, and maintenance) by the requester, and any appropriate terms and conditions set by the Secretary (e.g., preventing enlargement).
