§2. Report on amendment to the rules of evidence to further limit admissibility of evidence regarding an alleged victim’s sexual behavior or predisposition and to improve privacy protections for admissible evidence
This section directs the Judicial Conference to submit to Congress, not later than 180 days after enactment, three reports reviewing specified federal rules and identifying targeted amendments (in accordance with 28 U.S.C. chapter 131) to further limit admissibility of evidence on an alleged sexual assault victim's sexual behavior or predisposition (i.e., under Federal Rule of Evidence 412, the "rape shield" rule) and to enhance privacy protections for such victims' personal records in discovery: (1) a report on Rule 412 to further limit admissibility of such evidence and improve privacy protections for admissible evidence, including limits on subsequent disclosures; (2) a report on Federal Rule of Civil Procedure 26 to narrow discovery into victims' personal, financial, social, psychological, sexual, medical, or other private records (unless directly relevant), establish clearer privacy protections and disclosure limits, and ensure consistency with federal victims' rights laws; and (3) a report on Federal Rule of Criminal Procedure 16 with parallel changes to narrow discovery scope, enhance privacy protections and disclosure limits, and ensure consistency with federal victims' rights laws.
