H.R. 3612 — End For-Profit Prisons Act of 2025

This section prohibits contracting core correctional services (i.e., housing, safeguarding, protecting, and disciplining of federal prisoners and pretrial detainees) to non-federal entities at Bureau of Prisons (BOP) and United States Marshals Service (USMS) correctional facilities beginning 6 years after enactment, except that USMS may contract with state or local government-operated facilities meeting applicable standards where services are performed by state or local employees. It further prohibits the BOP director from entering or maintaining contracts with for-profit entities to provide or manage community confinement facilities (i.e., halfway houses and similar facilities per 28 CFR 115.5) beginning 8 years after enactment.

This section directs the Attorney General to phase out existing Bureau of Prisons and United States Marshals Service contracts for core correctional services and existing Bureau of Prisons contracts for community confinement facilities (i.e., halfway houses), which will be prohibited under 18 U.S.C. §4015 at the conclusion of the transition period.

This section requires the Attorney General to submit to Congress, not later than two years after enactment and biennially thereafter, a report describing and evaluating the prison population in the custody of the Bureau of Prisons (BOP). The report must include data on inmates' race, gender, age, nationality, and location of custody.

This section directs the Attorney General to conduct research evaluating the effectiveness of programs and policies in community confinement facilities (i.e., Bureau of Prisons-contracted halfway houses and similar facilities) in improving community reintegration, and to develop guidelines for their use based on that research. The section requires the Attorney General to submit to Congress, not later than four years after enactment and every four years thereafter, a report describing the research results, guidelines, and their incorporation into Bureau of Prisons contracts for such facilities.

This section requires the United States Marshals Service to conduct a thorough inspection of each correctional facility used for the confinement of persons in its custody, not later than one year after enactment and annually thereafter, to ensure compliance with constitutional requirements, federal statutes, USMS standards, and other applicable standards including state or local ones.

This section directs the Attorney General to issue rules ensuring that each prisoner released from federal custody upon the expiration of their term of imprisonment—including those residing in a community confinement facility—receives information and appropriate counseling on (1) any right to expunge their criminal record; (2) programs to remove employment barriers; (3) available vocational and educational rehabilitation programs; (4) a detailed record of their participation in educational, employment, and treatment programs completed while incarcerated; and (5) assistance with applications for nutritional assistance programs, Medicaid, Social Security, a driver's license, and voter registration.

This section establishes requirements for the Bureau of Prisons (BOP) Director in carrying out prerelease planning procedures under 18 U.S.C. §4042(a)(6)—which assist prisoners in obtaining benefits and identification upon release—and reentry planning procedures under §4042(a)(7), which provide information on health, employment, and other topics. The Director must ensure each prisoner receives information and counseling on those areas during prerelease procedures and must provide each released prisoner, including those in community confinement facilities, with information on fines, assessments, surcharges, restitution, and other penalties due in connection with the conviction (which judicial officers must supply to the BOP).
