H.R. 3619 — Patriots Over Politics Act

This section authorizes members of the Armed Forces who meet the service requirements of 38 U.S.C. 3319(b) and were separated (involuntarily or voluntarily) solely for refusing a COVID-19 vaccination between August 24, 2021, and January 10, 2023, to transfer their Post-9/11 GI Bill entitlement to eligible dependents during the 90-day period beginning on the date of enactment, notwithstanding other provisions of law. Such transfers reflect the entitlement as of the date of separation. In the case of transfers to a child, the child may commence use after the service member completed at least six years of service (notwithstanding 38 U.S.C. 3319(g)(2)(A)). (As background, 38 U.S.C. 3319 generally allows eligible service members on active duty or with a service commitment to transfer up to 36 months of unused Post-9/11 GI Bill benefits to a spouse or child to promote recruitment and retention; normal rules restrict children's use of transferred benefits until the service member nears retirement eligibility.)
