H.R. 3634 — Interactive Federal Review Act

This section defines covered projects as highway projects funded by the Infrastructure for Rebuilding America (INFRA) grant program under 23 U.S.C. 117, the Mega grant program under 49 U.S.C. 6701, or the Rebuilding American Infrastructure with Sustainability and Equity (RAISE) grant program under 49 U.S.C. 6702 (formerly the Better Utilizing Investments to Leverage Development (BUILD) grant program). It directs the Secretary of Transportation to encourage use of interactive, digital, cloud-based platforms and high-fidelity, three-dimensional digital models of infrastructure (i.e., digital twins) for National Environmental Policy Act (NEPA) environmental reviews and community engagement by issuing technology-neutral guidance within 90 days of enactment. The section further requires the Secretary to (1) select at least 10 covered projects to demonstrate such use, including additional projects on sponsor request; (2) give priority, notwithstanding other law, to grant applications under the specified programs that plan to implement these tools for NEPA processes; and (3) submit to congressional committees (A) within 180 days of enactment, a report on efficacy including efficiency metrics, community engagement measures, and digital workflow examples; and (B) within one year of enactment, at least five example NEPA documents (environmental impact statements, environmental assessments, or categorical exclusions) developed using these tools, also published on the Department of Transportation website. It includes a savings provision preserving state authorities under the surface transportation project delivery program (23 U.S.C. 327).
