H.R. 3649 — Magnus White Cyclist Safety Act of 2025

This section directs the Secretary (of Transportation) to issue, not later than three years after enactment, a final rule establishing minimum performance standards for automatic emergency braking systems in new covered vehicles. The standards require such systems to (1) function in daylight and low light conditions; (2) meet the maximum activation speed threshold for the covered vehicle; and (3) detect and respond to vulnerable road users (i.e., pedestrians, cyclists), including across the entire range of skin colors, complexions, clothing, and protective gear.

This section requires the Secretary, when issuing the final rule under section 2(a), to establish a compliance date no later than two motor vehicle model years after the model year in which the rule is issued.

This section defines terms for purposes of the Act: (1) automatic emergency braking system, as given in section 127 of part 571 of title 49, Code of Federal Regulations; (2) covered vehicle, including passenger cars, multipurpose passenger vehicles, and trucks with a gross vehicle weight rating (GVWR) of 4,536 kilograms (10,000 pounds) or less; (3) multipurpose passenger vehicle, meaning a motor vehicle capable of carrying a maximum of 10 people and built on a truck chassis or with special features for occasional off-road use; (4) passenger car, meaning a motor vehicle capable of carrying a maximum of 10 people that is not a motorcycle, trailer, or multipurpose passenger vehicle; (5) Secretary, meaning the Secretary of Transportation; and (6) vulnerable road user, as defined in 23 U.S.C. §148(a) and including bicyclists, motorcyclists, and other cyclists.
