H.R. 3669 — REAL ID Gender Requirement Reform Act

This section revises minimum data standards for REAL ID-compliant driver's licenses and identification cards (i.e., state-issued documents accepted for federal purposes such as boarding commercial aircraft) by striking the requirement for a gender designation, redesignating paragraphs (4) through (9) as paragraphs (3) through (8), and adding a new subsection authorizing states to include a gender or sex field at their discretion. If included, an individual self-designates the appropriate option without additional documentation (such as a doctor's note), and the state must provide an unspecified or other designation in addition to male or female. This section also makes a conforming amendment to the Court Security Improvement Act of 2007 to update a cross-reference from section 202(b)(6) to section 202(b)(5).
