§2. Housing
This section amends the Fair Housing Act (42 U.S.C. 3601 et seq.) to (1) add definitions in section 802 of "gender identity" (i.e., gender-related identity, appearance, mannerisms, or other gender-related characteristics regardless of designated sex at birth) and "sexual orientation" (i.e., homosexuality, heterosexuality, or bisexuality); (2) expand section 802 to cover discrimination based on association with a person in a protected class (race, color, religion, sex including sexual orientation and gender identity, handicap, familial status, or national origin) or perception or belief—even if inaccurate—about an individual's protected class status; and (3) insert "(including sexual orientation and gender identity)" after "sex" in the anti-discrimination provisions of sections 804, 805, 806, and 808(e)(6). This section further amends the criminal prohibition on intimidation and interference with fair housing rights (42 U.S.C. 3631)—which imposes penalties of up to one year imprisonment (or up to 10 years if bodily injury results or dangerous weapons, explosives, or fire are involved; or if death, kidnapping, aggravated sexual abuse, or attempted killing results)—to include sexual orientation and gender identity (as defined in new section 802) within protections against "sex" discrimination.
