H.R. 3723 — Tribal Gaming Regulatory Compliance Act

This section sets forth six congressional findings on the history and regulation of Indian gaming, including the Supreme Court's 1987 California v. Cabazon Band of Mission Indians decision, the Indian Gaming Regulatory Act (which currently regulates over 200 tribes in 28 states), and the 2022 Supreme Court ruling granting the Ysleta del Sur Pueblo and Alabama-Coushatta Tribe of Texas a unique gaming status under separate restoration legislation.

This section amends the Ysleta del Sur Pueblo and Alabama and Coushatta Indian Tribes of Texas Restoration Act of 1987 (which restored federal recognition to the tribes but prohibited gaming activities under the Indian Gaming Regulatory Act (IGRA)) by (1) inserting a new section 3 establishing a rule of construction to ensure full IGRA applicability to gaming on the tribes' Indian lands; (2) striking section 107 (prohibiting gaming by the Ysleta del Sur Pueblo); and (3) striking section 207 (prohibiting gaming by the Alabama-Coushatta Tribe of Texas). (Thus, the tribes may now conduct Class III gaming pursuant to IGRA compacts with Texas.)
